1. Acceptance of Terms
By accessing or using Motioneer ("the Service"), operated by Motioneer ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Motioneer is an AI-powered text-to-animation generation platform. Users can submit text prompts to generate character animation files (FBX format) for use in game engines and 3D applications.
3. Accounts
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 16 years old to use the Service.
4. Subscriptions and Billing
Certain features require a paid subscription. Subscriptions are billed monthly or annually through PayPal. You may cancel at any time; your access continues until the end of the current billing period. Refunds are handled on a case-by-case basis.
5. Usage Credits
Each subscription plan includes a set number of generation credits per billing period. Unused credits do not roll over. One credit is consumed per animation generation, regardless of the output quality or duration.
6. Intellectual Property
You retain ownership of animation files generated through the Service using your prompts. You grant us a limited license to process your prompts and store generated files as necessary to provide the Service. You may use generated animations for personal and commercial projects.
7. Acceptable Use
You agree not to:
- Use the Service to generate content that is illegal, harmful, or violates the rights of others
- Attempt to reverse-engineer, exploit, or circumvent usage limits or security measures
- Resell access to the Service without our written permission
- Use automated tools to excessively consume resources
8. Service Availability
We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control. We are not liable for any losses resulting from downtime.
9. Limitation of Liability
To the maximum extent permitted by law, Motioneer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
We may suspend or terminate your account at any time for violation of these terms or for any reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data by contacting support.
11. Changes to Terms
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify users of material changes via email or in-app notification.
